South Bay Athletic Club Membership Cancellation Procedures

We value your business and are sorry to hear that you are cancelling your membership.  We strive to make this process as simple as possible so that your entire experience at SBAC has been positive.  The following section of this web site explains the process for cancelling your membership.  Please note that effective January 1, 2006, the "Buyer's Right To Cancel" has been changed from 3 days to 5 days for all regular memberships purchased.  Memberships purchased prior to January 1, 2006, are subject to the prior CA civil codes in force at the time of membership purchase.   Should your situation change, we would love the opportunity to welcome you back as a member in the future.

5-Day Buyer's Right To Cancel:

If you wish to cancel a Membership Agreement (does not apply to short-term visits) within 5 SBAC business days of the date you sign it, you may cancel this Membership Agreement by coming into the club and signing a cancellation form or delivering or mailing by certified mail, returned receipt requested, written notice to this club.  Cancellations must be in writing and are never accepted verbally for your protection.  The club will process refund on a 5-day cancel within 30 days.  The notice must clearly indicate that you are canceling this Membership Agreement. The notice must be delivered or mailed to South Bay Athletic Club, 271 Houret Drive, Milpitas, CA 95035, and must be received by SBAC within 5 days of the date you sign this Membership Agreement.  You will be responsible for payment for any services utilized during the 5-day period.   Please note that short-term guest privilege such as daily guest pass, discounted one-visit punch passes, and passes for under a month period are for guest privileges for day use only and are not memberships and are not refundable or transferable.

Cancellation of Membership:

All SBAC memberships are for a minimum one-year commitment (except short-term visits).  After completion of your 12-month commitment, the membership will continue and roll over to a month-to-month commitment after the first year.   You are not charged any additional fees and the rate will remain the same unless you upgrade your services, etc.  Effective January 1, 2006, all members will be required to complete a new authorization on a yearly basis to continue the membership. 

To cancel membership--it's simple:  Come in and sign a Membership Cancellation Request

For your convenience, we have a simple process for cancelling your membership.  Come in to the club and sign a cancellation form.  Any one of our front desk staff members can assist you with this process.  You will be given a copy of your cancellation request with a confirmation number.  All cancellations will be processed as per the cancellation policy.  Cancellations are not accepted over the phone, verbally, or via email.  SBAC carefully monitors all cancellations to ensure that cancellations are processed correctly, and in accordance with your membership agreement.  We maintain records of all cancellations for your protection. 

Cancellation Policies:

As per your membership agreement, the following policies apply to all membership cancellation requests.

1.  If a membership is canceled in the first 12 months, a $100 cancellation fee will be assessed.

2.  All cancellations must be received in writing to prevent error.  Cancellations are not accepted over the phone or via email.

3.  Notice is required 30 days prior to the next billing date for cancellation of membership. 

       For example:  If you wish to cancel a membership by November (meaning not be billed for November), you will need to notify us no later than October 1st.

4.  It is the member's sole responsibility to request cancellation of their membership.

5.  All outstanding payments, charge accounts, etc., by member and their representatives must be paid for the account to be closed.

6.  The membership card is the property of SBAC and must be returned.

7.  SBAC will process your request in accordance with this cancellation policy.  Once you have completed the cancellation form, no further communication will be required unless additional information is necessary (i.e., unpaid balances, etc.)

8.  The membership rate is not guaranteed to individuals who have canceled their membership.  Current membership rates will apply for previous members who have canceled their membership.  Memberships will only be accepted from previous members who have canceled their memberships in good standing with all outstanding debts paid.

If you only want to stop your membership for a few months, review our FREEZE policy, described under "Membership Freeze (put on hold) section, and see if that is a better option for you.
